By accessing the Aeyora website, creating an account, installing an integration, using the dashboard, or otherwise using any part of the service, you agree to be bound by these Terms and Conditions. If you do not agree, do not access or use the service.
If you are accepting these terms on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these terms. In that case, "you" and "your" refer to that entity.
Aeyora is a software-as-a-service analytics platform that collects, stores, and processes event data from connected stores, websites, and applications, and provides AI-powered analysis and reporting features through a web dashboard.
Aeyora reserves the right to modify, suspend, or discontinue any part of the service at any time, with or without notice. Aeyora will not be liable to you or any third party for any modification, suspension, or discontinuation of the service.
You must provide accurate, current, and complete information when creating an account and keep that information updated. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
You must notify Aeyora promptly of any suspected unauthorized use of your account. Aeyora is not liable for any loss or damage arising from your failure to protect your credentials.
Aeyora may suspend or terminate accounts that violate these terms, that have been inactive for an extended period, or where required by law or to protect the security or integrity of the service.
Access to the service requires a paid subscription. Subscription fees are charged in advance on a monthly or annual basis depending on the plan selected. All fees are non-refundable except where required by law or as otherwise stated in these terms.
Aeyora uses a third-party payment processor to handle billing. By providing payment information, you authorize Aeyora and its payment processor to charge the applicable fees. You are responsible for ensuring your payment information remains accurate and up to date.
Aeyora may change subscription pricing at any time. If pricing for your active plan changes, Aeyora will provide reasonable notice before the change takes effect. Continued use of the service after notice of a price change constitutes acceptance of the new pricing.
You may use the service only for lawful purposes and in accordance with these terms. You agree not to use the service to collect or process data without appropriate consent from your end users, to violate any applicable law or regulation, to transmit malware or harmful code, to attempt to gain unauthorized access to any part of the service or its infrastructure, or to interfere with the availability or performance of the service.
You are solely responsible for ensuring that your use of the service — including the data you collect through Aeyora's tracking integrations — complies with applicable privacy laws and your own privacy policy obligations to your end users.
You retain ownership of all data you submit to or collect through the service ("Customer Data"). By using the service, you grant Aeyora a limited, non-exclusive license to store, process, and use Customer Data solely to provide and improve the service as described in the Privacy Policy.
You represent and warrant that you have all rights necessary to submit Customer Data to the service and that doing so does not violate any third-party rights or applicable law. Aeyora will not sell Customer Data to third parties.
Aeyora's AI analysis features use large language models and automated processing to generate insights, summaries, and responses based on your event data and queries. These outputs are generated automatically and may not always be accurate, complete, or suitable for a particular purpose.
You are responsible for independently verifying AI-generated outputs before making business decisions based on them. Aeyora does not warrant that AI outputs are error-free, and Aeyora is not liable for decisions made in reliance on AI-generated analysis.
Conversation history and query context may be retained server-side to support continuity of AI sessions. Refer to the Privacy Policy for details on how interaction data is stored and governed.
The Aeyora service, including the platform, dashboard, SDKs, APIs, documentation, design, and underlying technology, is owned by Aeyora and protected by applicable intellectual property laws. Nothing in these terms transfers ownership of any Aeyora intellectual property to you.
Subject to your compliance with these terms and payment of applicable fees, Aeyora grants you a limited, non-exclusive, non-transferable, revocable license to access and use the service for your internal business purposes during your subscription term.
The service may integrate with or connect to third-party platforms, services, or APIs such as Shopify, Wix, payment processors, or authentication providers. Aeyora does not control and is not responsible for the availability, accuracy, security, or practices of those third-party services.
Your use of any third-party service connected to Aeyora is governed by the terms and privacy policies of that third party. Aeyora is not liable for any loss or damage arising from your use of or reliance on third-party integrations.
Each party may have access to the other's confidential information in connection with the service. Each party agrees to protect the other's confidential information using reasonable care and not to disclose it to third parties except as required by law, as needed to provide the service, or with the other party's written consent.
Confidentiality obligations do not apply to information that is or becomes publicly available without breach of these terms, that was already known to the receiving party, or that is independently developed without reference to the confidential information.
The service is provided "as is" and "as available" without warranties of any kind, whether express or implied. Aeyora expressly disclaims all implied warranties of merchantability, fitness for a particular purpose, and non-infringement to the maximum extent permitted by applicable law.
Aeyora does not warrant that the service will be uninterrupted, error-free, or free from harmful components, or that any defects will be corrected. You use the service at your own risk.
To the maximum extent permitted by applicable law, Aeyora and its affiliates, directors, employees, and licensors will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or business opportunities, arising out of or in connection with your use of the service, even if Aeyora has been advised of the possibility of such damages.
Aeyora's total aggregate liability arising out of or related to these terms or the service will not exceed the greater of the fees paid by you to Aeyora in the twelve months preceding the claim or one hundred US dollars.
You agree to indemnify, defend, and hold harmless Aeyora and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with your use of the service, your Customer Data, your violation of these terms, or your violation of any third-party rights or applicable law.
Either party may terminate the service relationship at any time. You may cancel your subscription at any time through your account settings; cancellation takes effect at the end of the current billing period. Aeyora may suspend or terminate your access immediately if you violate these terms or if required by law.
Upon termination, your right to access the service ends. Aeyora may delete your Customer Data following termination in accordance with its data retention practices and applicable law. Provisions of these terms that by their nature should survive termination will continue to apply.
These terms are governed by and construed in accordance with applicable law. Any disputes arising under or in connection with these terms shall be resolved through good-faith negotiation where possible, and otherwise through the courts or dispute resolution mechanisms of the applicable jurisdiction.
Aeyora may update these Terms and Conditions from time to time. Material changes will be communicated by posting a notice in the dashboard or sending an email to the address on file, with a reasonable period before the changes take effect. Continued use of the service after the effective date of updated terms constitutes acceptance of those terms.
